These Terms & Conditions ("Terms") govern your use of OvenSaathi (the "Service"), available at ovensaathi.com and its sub-domains, operated by Techwarezen Pvt Ltd ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
OvenSaathi is a software-as-a-service platform that lets bakeries and cake shops ("Shop Owners") create a website, list products, receive orders on WhatsApp, manage customers and send messages such as order updates, birthday wishes and offers. Customers of a shop ("Customers") may browse a shop website, place orders and create an account with that shop.
2. Accounts
- You must provide accurate information, including a valid mobile number, and keep your password confidential.
- You are responsible for all activity under your account. Tell us immediately if you suspect unauthorised use.
- You must be at least 18 years old and legally able to enter into a contract in India to open a Shop Owner account.
3. Free trial and subscription
- New shops get a free trial of 1 day. After the trial, a paid plan is needed to keep the website live.
- Plans are prepaid for the chosen period (1, 3, 6 or 12 months) and do not renew automatically.
- Prices are shown in Indian Rupees on our pricing page and may change with notice. Changes do not affect a period you have already paid for.
- Payments are processed by our payment partner (Cashfree Payments). We do not store your card or bank details.
- If a plan expires, the shop website is paused. Your data is kept so you can renew and continue.
4. Shop Owner responsibilities
- You are the seller of your products. Product quality, pricing, taxes, food safety licences (including FSSAI), delivery and customer service are your responsibility.
- Orders are a contract between you and your Customer. We are not a party to that sale and do not collect payments for orders.
- You must only upload content (logos, photos, text) that you own or have the right to use.
- You must have your customers' consent before sending them WhatsApp messages, wishes or offers, and follow WhatsApp's own terms and policies. Sending spam can get your number blocked by WhatsApp; we are not responsible for such action.
5. WhatsApp and third-party services
Messages are sent from the Shop Owner's own WhatsApp number using the method the Shop Owner chooses (linked device, WhatsApp Cloud API or another provider). WhatsApp is a service of Meta Platforms and is not operated by us. Delivery of messages depends on these third parties, and we do not guarantee delivery of every message.
6. Acceptable use
You must not use the Service to sell illegal or restricted goods, upload harmful or misleading content, attempt to break or overload the Service, access other users' data, or resell the Service without our written permission. We may suspend or close accounts that break these rules.
7. Intellectual property
The Service, its software, designs and the OvenSaathi name belong to Techwarezen Pvt Ltd. Your shop content remains yours; you give us a licence to host and display it only to run the Service for you.
8. Availability
We work to keep the Service available at all times but do not promise uninterrupted service. We may carry out maintenance and updates, and will try to keep disruption to a minimum.
9. Limitation of liability
To the extent permitted by law, the Service is provided "as is". Techwarezen Pvt Ltd is not liable for indirect or consequential losses, lost profits or lost orders. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate an account for breach of these Terms, non-payment or legal reasons. On request, we will delete your shop data as described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at the city of our registered office.
